These Terms of Use ("Terms") govern your access to and use of the Sip Savvy mobile application (the "App"), operated by Blue Dog Ventures LLC ("Company," "we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be 21 years of age or older to use the App. By using the App, you represent and warrant that you meet this requirement.
Use of the App is limited to individuals located within the United States.
2. Subscriptions and Payments
Access to premium features is provided through Apple App Store subscriptions. Apple's terms and billing policies apply to all transactions.
We may add additional payment options in the future, in which case updated terms will apply.
3. User Content
The App allows users to upload photos of wine lists, record ratings, and note wine selections.
Uploaded photos are stored anonymously and are not tied to a specific user account.
You are solely responsible for ensuring that any content you upload does not violate third-party rights (e.g., copyrighted menus, logos).
4. Data Storage and Deletion
All personal usage data (wine ratings, selections, history) is stored locally on your device and/or in your personal iCloud account.
You may delete your personal data at any time by using the "Delete My Data" option in the App's settings.
Photos uploaded for wine list processing are anonymized and cannot be individually deleted.
5. Acceptable Use
You agree not to:
- Use the App for unlawful purposes or in connection with promoting excessive or irresponsible consumption of alcohol.
- Attempt to reverse engineer, scrape, or interfere with the operation of the App.
- Use the App to collect or transmit malicious software or unauthorized data.
6. Intellectual Property
All intellectual property in the App (including trademarks, software, design, and content other than User Content) belongs to Blue Dog Ventures LLC. You may not copy, modify, or distribute any portion of the App without prior written consent.
7. Disclaimers
The App is provided "as is" and "as available" without warranties of any kind.
We do not guarantee the accuracy, completeness, availability, or suitability of any wine recommendations, ratings, or other information presented in the App.
We are not responsible for user choices, including wine purchases or consumption decisions.
8. Limitation of Liability
To the maximum extent permitted by law, Blue Dog Ventures LLC will not be liable for any indirect, incidental, special, or consequential damages arising from or related to your use of the App.
9. Termination
We reserve the right to suspend or terminate your access to the App at any time, without notice, if you violate these Terms.
10. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles.
